HB 1143 is an anti-vaping bill that could result in hundreds of Vape shops across the state of Florida closing their doors and make it illegal to carry a vaping device.

 HB 1143 is an act relating to the Florida Clean Indoor Air Act; amending s. 386.203, F.S.; revising the definition of the term “smoking” to include the use of nicotine dispensing devices.   The bill would read;  386.203 (10) “Smoking means inhaling, exhaling, carrying, or possessing a nicotine dispensing device as defined in s. 877.122.”

This would make also make it illegal to carry or possess nicotine dispensing devices such as mods and drippers anywhere and carries very stiff penalties and fines.

The penalties are as follows:

“If the proprietor of an enclosed indoor workplace violates the prohibition, DOH or DBPR may assess a civil penalty against the person. Fines of $250 for a first offense, $500 for a second offense, and $1,000 for a third offense may be assessed for specific violations.

In addition, any person who violates the smoking prohibition commits a noncriminal violation punishable by a fine of not more than $100 for the first violation and not more than $500 for each subsequent violation.”
